最近,陸續有賣家咨詢自己的亞馬遜賬號因為DMCA(反通知)而被封號的情況:

Your Amazon seller account has been deactivated in accordance with section 3 of Amazon's Business Solutions Agreement. Your listings have been removed.
Why did this happen?
We took this measure due to incorrectly using the DMCA counter-notice process . This is a violation of Amazon’s Seller Policies and Seller Code of Conduct:

為什么會這樣?
我們采取這一措施是因為不正確地使用了DMCA反通知程序。這違反了亞馬遜的賣家政策和賣家行為準則:https://sellercentral.amazon.com/gp/help/G1801


首先,我們先來了解下什么是反通知?

進行反通知時我們需要注意以下幾點:
1.DMCA 反通知僅適用于在美國收到的版權聲明;
2.認為投訴的內容并不侵權;
3.聲明需要真實,無任何修改,并承擔相應的法律責任;
而根據最近幾個此類型的case溝通后得到得細節,賣家在進行反通知前,先對申訴的listing(asin)內容進行了修改,再提交DMCA(反通知),這一行為,被亞馬遜判定不正確地使用了DMCA反通知程序。
溫馨提示DMCA反通知是認為投訴的內容并不侵權,所以是無需進行任何修改的;反之,如果需要進行修改,那就只能承認侵權進行正規申訴。
還有另一種是被判了行為準則,根據客戶內部查因出來的結果是使用DMCA反通知程序欺詐:

從內部查因結果備注:審核出該賣家無權銷售這些產品,并且冒用DMCA反通知避免移除ASIN, 指出:沒有法律批準不得回復。
申訴:必須走法律程序或者由權利人發給亞馬遜的撤訴信,不然拒絕。
